Rules for using the Tropicay website and information on personal data processing.
Terms of the Tropicay website
§ 1. General provisions
- These Terms define the rules for using the Tropicay website available at www.tropicay.pl (the “Website”).
- The Website is operated under the Tropicay brand by two sole traders:
- Oliwia Czuba “Tropicay”, Polish tax identification number (NIP) 9512653508;
- Marta Paliszewska “Tropicay”, Polish tax identification number (NIP) 9512653514.
- The entrepreneurs identified above act as joint controllers of personal data within the meaning of Article 26 GDPR.
- Use of the Website constitutes acceptance of these Terms.
§ 2. Definitions
- Website – the Tropicay website.
- Tropicay – a brand jointly operated by two entrepreneurs.
- User – a person using the Website.
- Partner – an independent entrepreneur operating in the Republic of Indonesia and providing travel-related services.
- Form – the contact form allowing Users to provide information about a planned trip.
§ 3. Nature of the Website
- The Website is informational and contact-based.
- It enables people interested in travelling to Indonesia to provide their expectations and contact the Partner.
- Tropicay does not organise package travel, enter into travel-service contracts, accept payments, provide travel services in its own name, or act on behalf of the Partner.
- Tropicay only provides the Form, collects information voluntarily supplied by the User and forwards the enquiry to the Partner.
- After the enquiry is forwarded, further contact takes place directly between the User and the Partner.
§ 4. Contact form
- The User may provide information about a planned trip through the Form.
- Submitting the Form does not constitute a contract, booking, order for travel services or an obligation for the Partner to prepare an offer.
- It only expresses the User's wish to contact the Partner.
§ 5. Transfer to the Partner
- User data may be transferred to the Partner solely to enable contact and presentation of a travel proposal.
- The Partner operates in the Republic of Indonesia.
- After receiving the data, the Partner independently communicates with the User.
§ 6. Liability
- Tropicay exercises due care in operating the Website and is responsible only for its operation and forwarding enquiries.
- Tropicay is not responsible for the Partner's proposals, negotiations, contracts, performance, service quality, price changes, cancellation of travel or the Partner's liability.
- Claims relating to the Partner's services must be addressed directly to the Partner.
§ 7–11. Other provisions
Website content is legally protected. Complaints concerning the Website may be sent to info@tropicay.pl and are considered within 14 days. Tropicay may amend the Terms for important reasons, including changes in law, Website functionality or organisation. Polish law applies; matters not regulated are governed by applicable Polish law, including the Civil Code and GDPR.

The joint controllers of personal data under Article 26 GDPR are:

2. Data, purposes and legal bases
We may process information voluntarily provided in the Form, including name, country, email, telephone or WhatsApp number, traveller details, dates, budget, preferences and additional messages. We process it to handle and forward the enquiry (Article 6(1)(b) GDPR), manage correspondence, ensure security and defend claims (Article 6(1)(f) GDPR), and transfer it to the Partner in Indonesia on the basis of explicit consent after information about risks (Article 49(1)(a) GDPR). Special-category data voluntarily provided is processed on the basis of explicit consent (Article 9(2)(a) GDPR).
3. Transfer outside the EEA
The enquiry may be transferred to an independent Partner in Indonesia so that the Partner can contact the User and prepare a travel proposal. Indonesia is outside the EEA. Where there is no adequacy decision or other appropriate safeguard, the transfer takes place on the User's explicit consent. Indonesian law and remedies may not provide protection equivalent to EU standards. The Partner may independently control subsequent processing.
4. Recipients, retention and rights
Recipients may include the Partner, hosting, email, IT and legal-service providers, and competent authorities. Data is retained for the time needed to handle the enquiry and subsequently for the period required to demonstrate proper handling or until claims expire. The User has the rights of access, rectification, erasure, restriction, portability, objection, withdrawal of consent and complaint to the Polish supervisory authority.
5. Cookies and security
Providing data is voluntary, but required fields are necessary to handle the enquiry. Without consent to the transfer, the enquiry cannot be sent to the Partner. The Website may use necessary cookies and basic technical data for proper and secure operation. No solely automated decisions producing legal or similarly significant effects are made. Appropriate technical and organisational safeguards are applied.
